RETREAT TERMS AND CONDITIONS
Effective Date: May 15, 2026
By registering for, paying for, or attending the retreat organized by Spark & Stillness (“we,” “us,” “our,” or the “Organizer”), you (“Attendee”) agree to be bound by these Terms and Conditions. Please read them carefully before completing your registration.
1. Registration and Payment
• Registration is confirmed only upon receipt of full payment or an approved payment plan.
• All fees must be paid in the currency and by the method specified at the time of booking.
• Retreat fees cover only those items expressly listed in the retreat package description. Any additional costs, including but not limited to airfare, ground transportation, travel insurance, meals not specified, visa fees, and personal expenses, are the sole responsibility of the Attendee.
2. Cancellation by the Attendee
If you need to cancel your registration, the following refund schedule applies:
• [90+ days] before the retreat start date: Full refund, less a [$200] administrative fee. 90 days before the retreat start date is September 13, 2026.
• [Less than 90] before the retreat start date: No refund.
All cancellation requests must be submitted in writing to [dettefox@gmail.com]. The date the written notice is received will determine the applicable refund tier.
3. Cancellation or Modification by the Organizer
We reserve the right to cancel, reschedule, or modify the retreat at any time and for any reason, including but not limited to insufficient enrollment, venue or vendor unavailability, weather or natural disasters, public health concerns, travel advisories, or any other circumstance beyond our reasonable control.
In the event of cancellation by the Organizer:
• We will provide written notice to all registered Attendees as soon as reasonably practicable.
• Attendees will receive a full refund of retreat fees paid directly to the Organizer, or, at the Organizer’s discretion, a credit toward a future retreat of equal value.
Limitation of Liability for Third-Party Costs:
The Organizer shall not be responsible or liable for any costs, fees, expenses, or losses incurred by the Attendee in connection with the retreat that were not paid directly to the Organizer. This includes, without limitation:
• Airline tickets, flight change fees, or cancellation penalties
• Hotel or accommodation bookings made independently by the Attendee
• Ground transportation, car rentals, or ride-share costs
• Travel insurance premiums
• Visa or passport application fees
• Excursions, activities, or services booked through third parties
• Any other personal or travel-related expenses
Attendees are strongly encouraged to purchase comprehensive travel insurance that covers trip cancellation, interruption, and non-refundable expenses to protect against potential losses.
4. Force Majeure
The Organizer shall not be held liable for failure to perform any obligation under these Terms if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, pandemics, epidemics, government restrictions, war, terrorism, civil unrest, natural disasters, extreme weather, strikes, or supplier failures. In such events, the cancellation terms outlined in Section 3 shall apply.
5. Assumption of Risk
Participation in retreat activities may involve physical, emotional, or other risks. By attending, you acknowledge that you are voluntarily participating and assume all risks associated with your participation, including but not limited to physical injury, illness, emotional distress, or property damage. You agree to follow all safety instructions and guidelines provided by the Organizer and its agents.
6. Health and Medical
Attendees are responsible for disclosing any medical conditions, allergies, dietary restrictions, or physical limitations that may affect their participation. The Organizer does not provide medical services and is not responsible for any health-related incidents during the retreat. Attendees are advised to consult with a healthcare professional before participating in any retreat activities.
7. Liability Waiver and Indemnification
To the fullest extent permitted by law, the Attendee agrees to release, waive, and hold harmless the Organizer, its officers, directors, employees, agents, contractors, and affiliates from any and all claims, liabilities, damages, losses, or expenses arising out of or related to the Attendee’s participation in the retreat.
The Attendee agrees to indemnify and hold harmless the Organizer against any claims brought by third parties arising from the Attendee’s actions or omissions during the retreat.
8. Code of Conduct
All Attendees are expected to behave in a respectful and considerate manner toward fellow participants, staff, and the retreat environment. The Organizer reserves the right to remove any Attendee whose behavior is deemed disruptive, harmful, or in violation of these Terms, without refund.
9. Photography and Media
The Organizer may capture photographs, video, or audio recordings during the retreat for promotional and marketing purposes. By attending, you grant the Organizer a non-exclusive, royalty-free, perpetual license to use your likeness in such materials. If you do not wish to be photographed or recorded, you must notify the Organizer in writing prior to the retreat.
10. Privacy
Personal information collected during registration will be used solely for retreat administration and communication purposes. The Organizer will not sell or share your personal information with unaffiliated third parties except as necessary to deliver retreat services or as required by law.
11. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of [State/Province/Country]. Any disputes arising under or in connection with these Terms shall be resolved through [mediation/arbitration/the courts of competent jurisdiction in (location)].
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms and Conditions, together with any retreat-specific information provided at the time of registration, constitute the entire agreement between the Organizer and the Attendee. No verbal representations or promises shall modify these Terms unless confirmed in writing by the Organizer.
14. Acknowledgment and Acceptance
By completing your registration and/or submitting payment, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
